- Thailand is moving to tighten access to overseas crypto derivatives, forcing intermediaries to apply stronger product and exchange checks as regulators seek to protect investors from complex and high risk digital assets.
Thailand is preparing tougher safeguards for investors seeking exposure to cryptocurrency derivatives traded overseas, in the latest sign that regulators are tightening control around increasingly complex digital asset products.
The Securities and Exchange Commission has opened a public consultation on proposed amendments that would govern how financial intermediaries facilitate overseas digital asset derivatives for retail, high net worth and ultra-high net worth investors.
Under the proposal, products available to these investors would have to meet standards broadly comparable with derivatives permitted in Thailand. Regulators would assess the underlying digital asset, contract maturity, leverage and delivery or settlement arrangements.
The trading venue would also face scrutiny. Eligible contracts would need central counterparty clearing and must be traded on an exchange overseen by a regulator that is a Signatory A to the IOSCO Multilateral Memorandum of Understanding or on a World Federation of Exchanges member platform.
More complex overseas products could still be offered, but only to institutional investors, reflecting regulators’ view that sophisticated institutions are better equipped to assess and manage higher risks.
THE COMPLIANCE SIGNAL
Thailand’s move is part of a wider effort to bring digital assets deeper into the regulated financial system. The SEC has also been developing frameworks for crypto ETFs, digital asset derivatives and stronger capital and custody requirements.
The direction is significant for Africa’s growing crypto market.
The regulatory lesson is clear: cross border access does not mean regulatory freedom.
Banks, fintechs, brokers and crypto platforms facilitating offshore products will increasingly need to understand not only who the customer is, but what product the customer is buying, where it is traded, who supervises the venue, how it is cleared and how the risks are controlled.
Thailand is effectively putting a compliance gate around the offshore crypto market.
For digital asset intermediaries, the age of simply passing customers through to overseas platforms is coming under pressure.
